    Abstract: 土地征收补偿价格与被征收人的权益关系甚巨,2012年土地征收条例修正后,地价补偿由原先的公告土地现值加四成(旧制),改为以市价补偿(新制)。土地征收补偿市价查估办法更明订,得委托估价师查估补偿价格,并且导入不动产估价技术规则的估价方法,同时于现有的区段地价体制下,增加个别因素调整方式,以求取个别宗地的价格。此政策是改革土地征收补偿估价的契机,其将补偿理念由相当补偿导入完全补偿,并且将区段地价导入个别宗地估价,期使补偿更具合理性与公平性。然而,新的制度即将实施,必然存在一些值得探讨的问题。
